A U.S. judge weighing how much BP Plc should be punished for the 2010 Gulf of Mexico oil spill on Thursday refused to overturn his own finding that the oil company’s conduct was “grossly negligent.”

It marks the latest setback in BP’s effort to curb costs from the April 20, 2010, explosion of the Deepwater Horizon rig, which led to 11 deaths and the largest U.S. offshore oil spill. The trial is expected to resume in January.

Barbier had on Sept. 4 ruled that BP committed gross negligence and was 67 percent at fault for the spill.

Momentum that was gained on exposing the geoengineering at the Shasta County Board of Supervisors meeting on August 15 is still growing rapidly.

The presentation on the 21st is an furthering of this effort, many of the same experts will be in attendance with updated information for the panel discussion and Q and A session. This event will also be the launch for the next step in the battle to raise awareness, more details will be announced on the night of the event. The event will be professionally filmed, edited, and later posted on youtube and other websites as was the Shasta County Board of Supervisors event.

Low-level radiation from Japan’s Fukushima nuclear accident has been detected in multiple samples of ocean water off the Pacific Coast of the U.S. and Canada, the Woods Hole Oceanographic Institution is reporting.

The sample nearest to shore was taken about 100 miles off the coast of Eureka, in Northern California.

The levels are far below those that might pose a risk to human health or marine life, said Ken Buesseler, a WHOI marine chemist who is leading the monitoring effort.

“The levels are only detectable by sophisticated equipment able to discern minute quantities of radioactivity,” Buesseler said.

And so far, no samples taken from beaches have tested positive for Fukushima radiation.

Massive amounts of contaminated water were released from the Fukushima Dai-ichi nuclear power plant following a March 2011 earthquake and tsunami. Radioactive water has continued to leak and be released from the complex.

The radioactive plume has traveled across the Pacific, propelled largely by ocean currents and being diluted along the way.

No state or federal agency is testing Pacific waters for radiation from the crippled plant, so earlier this year Buesseler launched a crowd-funded, citizen-science effort to collect surf samples to be tested at his lab in Massachusetts.

Buesseler is looking for cesium-134, the so-called “fingerprint” of Fukushima. Cesium-134 does not occur naturally in the environment and has a short two-year half-life, so any in the Pacific today had to come from Fukushima.

He’s also looking for higher-than-background levels of cesium-137, another Fukushima isotope that already is present in the world’s oceans from nuclear testing in the 1950s and 1960s.

Processing has been completed on about 50 of the surf samples, taken from the Bering Strait to San Diego. None have been positive for Fukushima radiation.

As the monster storm that once was Super Typhoon Nuri swept toward the western Aleutian Islands, bringing hurricane force winds and 50-foot waves, it may have been one for the record books. But luckily, there are no reported injuries or significant damage on the sparsely populated islands.

One measure of the strength of a storm is the atmospheric pressure at its center. The lowest pressure ever recorded in a North Pacific storm was 925 millibars, measured in Dutch Harbor in 1977. NOAA’s Ocean Prediction CenterThe pressure at the heart of the current storm is estimated to have bottomed out at 924 mb, which would make it the strongest on record for this part of the world. (Click on the thumbnail at right to see the estimate from NOAA’s Ocean Prediction Center.)

Meteorologists don’t have an actual measurement of the storm’s central pressure when it bottomed out because it happened over the open ocean, not over any weather monitoring stations. Even so, there’s no denying the storm’s fury and size.

The Texas town where America’s oil and natural gas boom began has voted to ban fracking, in a stunning rebuke to the industry.

Denton, a college town on the edge of the Barnett Shale, voted by 59% to ban fracking inside the city limits, a first for any locality in Texas.

Organisers said they hoped it would give a boost to anti-fracking activists in other states. More than 15 million Americans now live within a mile of an oil or gas well.

“It should send a signal to industry that if the people in Texas – where fracking was invented – can’t live with it, nobody can,” said Sharon Wilson, the Texas organiser for EarthWorks, who lives in Denton.

An energy group on Wednesday asked for an immediate injunction to keep the ban from being enforced. Tom Phillips, an attorney for the Texas Oil and Gas association, told the Associated Press the courts must “give a prompt and authoritative answer” on whether the ban violates the Texas state constitution.

Athens in Ohio and San Benito and Mendocino counties in California also voted to ban fracking on Tuesday. Similar measures were defeated in Gates Mills, Kent and Youngstown, Ohio, as well as Santa Barbara, California.

Denton remains a solidly Republican town, and oil companies reportedly spent $700,000 to defeat the ban, according to the Denton Record-Chronicle – nearly $6 for every resident.

“It was more like David and Godzilla then David and Goliath,” Wilson said. But she said residents were fed up with the noise and disruption of fracking, and the constant traffic and fumes from wells and trucks operating in residential neighbourhoods.

The town is probably the most heavily fracked in the country.

The industry has drilled wells on church property, school grounds and on the campus of the University of North Texas, right next to the tennis courts and across the road from the sports stadium (and a stand of giant wind turbines).

In Texas, as in much of America, property owners do not always own the “mineral rights” – the rights to underground resources – so typically have limited say over how they are developed.

A cloud that appeared in the sky over southeast Australia caused a stir on social media Tuesday after photos of the bizarre formation were posted all over Twitter and Instagram. The formation, which Internet users quickly labeled the “rapture” cloud, appeared a day earlier like a giant footprint over the seaside town of Wonthaggi, about 132 kilometers (82 miles) from Melbourne, in the state of Victoria.

Some explanations for the rare sight included aliens, paranormal activity and even an act of God. But believers in the supernatural might be disappointed to know that there was a perfectly logical explanation for the phenomenon, according to scientists. “It looks like a fallstreak cloud,” Michael Efron, a weather forecaster with Australia’s Bureau of Meteorology, told Fairfax Media. Fallstreak clouds, also known as hold punch clouds, are large, circular or elliptical gaps that appear in cloud cover. “They form when the water temperature in the cloud is below freezing, but the water has not yet frozen due to a lack of ice nucleation particles,” Efron said.

A fallstreak hole, also known as a hole punch cloud, punch hole cloud, skypunch, canal cloud or cloud hole, is a large circular or elliptical gap that can appear in cirrocumulus or altocumulus clouds. Such holes are formed when the water temperature in the clouds is below freezing but the water has not frozen yet due to the lack of ice nucleation particles (see supercooled water). When ice crystals do form it will set off a domino effect, due to the Bergeron process, causing the water droplets around the crystals to evaporate: this leaves a large, often circular, hole in the cloud.

It is believed that the introduction of large numbers of tiny ice crystals into the cloud layer sets off this domino effect of evaporation which creates the hole. The ice crystals can be formed by passing aircraft which often have a large reduction in pressure behind the wing- or propellor-tips. This cools the air very quickly, and can produce a ribbon of ice crystals trailing in the aircraft’s wake. These ice crystals find themselves surrounded by droplets, grow quickly by the Bergeron process, causing the droplets to evaporate and creating a hole with brush-like streaks of ice crystals below it. The articles by Westbrook and Davies (2010) and Heymsfield et al. (2010) explain the process in more detail, and show some observations of their microphysics and dynamics. Such clouds are not unique to any one geographic area and have been photographed from many places.

Because of their rarity and unusual appearance, as well as very little exposure in media, fallstreak holes are often mistaken for or attributed to unidentified flying objects.

TEPCO has hidden the truth about the Fukushima nuclear disaster and now drip feeds information so the public can get ready for the next piece of bad news, James Corbett, editor, The Corbett report, told RT’s In the Now show.

Journalist Jun Hori has quit NHK, the Japanese state broadcaster saying that his network restricted what he could say about the Fukushima nuclear disaster, and moved more slowly than others to report how far the radiation was spreading.

RT: Has TEPCO (Tokyo Electric Power Company) gotten away with hiding information from the public?

James Corbett: TEPCO has lied obfuscated and covered up the truth about what they knew about, or know about what is going on at sites since day one. And of course this goes back to the very beginning of the disaster when they knew within 72 hours that three of the reactors at the Fukushima No.1 plant site were in full melt down. In fact that they did not reveal to the public for almost three months after that event took place. And from there it only continues. We have cover-ups about the amount of radiation that has been released. TEPCO had to revise its original estimate up 250%. We have had cover up of the fact that there was and continues to be 300 tons of radioactive water flooding through the site. That wasn’t really revealed to the public until the summer of 2013, two years after the event took place. Cover-up after cover-up continuously being revealed and only very much later after the fact. I think TEPCO certainly has gotten away with an awful lot. Their practice seems to be, I am not sure if this is a coordinated strategy, but it certainly seems to be that it reveals information in dribs and drabs over long periods of time so that the public has time to be acclimatized to the last piece of bad news before the next one hits them.

RT: How tight is TEPCO with the Japanese government?

JC: Technically TEPCO has now been nationalized with the Japanese government being the largest stakeholder. So there is a direct Japanese government stake in the company. That is obviously a situation which creates a type of direct relationship between the company and the government in which obviously the interest of the government and interest of the company are directly tied financially. It creates a very worrying situation and the government has attempted to reform the nuclear regulatory agency here in Japan and attempted to set up a separate division of TEPCO for taking care of decontamination of the sites specifically. But arm’s length institutions or agencies like that are supposed to have oversight over this process aren’t really anything more than just a buffer between what is essentially the same thing now: the Japanese government/ TEPCO which are really wedded at the hip.

Following a two-year hiatus, the U.S. Nuclear Regulatory Commission (NRC) has resumed issuing license renewals for nuclear power plants. On October 20, the NRC renewed the operating licenses for Limerick Generating Station Units 1 and 2, located northwest of Philadelphia, extending their license expiration dates by 20 years, to 2044 and 2049, respectively. With this action, the NRC has granted license renewals providing a 20-year extension to a total of 74 of the 100 operating reactors in the United States. Nuclear power accounted for 20% of total power sector electricity generation in 2013.

License Expiration for Nuclear Power PlantsNRC has the authority to issue initial operating licenses for commercial nuclear power plants for a period of 40 years. The decision to apply for an operating license renewal is made by nuclear power plant owners, and it is typically based on economics and the ability to meet NRC regulations. Operating licenses are renewed by NRC for a period of 20 years. To date, no applications for a second, or subsequent, license renewal, which could extend nuclear plant operating lives to 80 years, have been filed.

Renewing an operating license is contingent on several factors, including the safe management and disposal of waste. The NRC must determine that it has reasonable confidence that spent nuclear fuel can and will, in due course, be disposed of safely. This is known as waste confidence. Waste confidence enables the NRC to license new reactors or renew their operating licenses without examining the effects of extended waste storage for each individual site pending ultimate disposal.

License Renewal Status Map for Nuclear Power PlantsIn June 2012, following the termination of the repository program at Yucca Mountain, the U.S. Court of Appeals for the District of Columbia Circuit struck down certain provisions of NRC’s Waste Confidence Rule and stated that NRC should have analyzed the environmental consequences of never building a permanent waste repository. In response, the NRC issued an order in August 2012 that suspended actions related to issuing license renewals as well as new operating licenses, although the nuclear power industry continued to submit applications for license renewals. On September 18, 2014, the NRC issued the revised and renamed Continued Storage of Spent Nuclear Fuel rule, which became effective on October 20. With the issuance of the revised rule, the NRC may now resume issuing license renewals as well as new operating licenses.

NRC is currently reviewing license renewal applications for 17 reactors, including one for Indian Point Unit 2. Although the September 2013 expiration date of the original 40-year operating license for that plant is already past, NRC rules allow for continued operation of a reactor until the NRC completes its review of a pending license renewal if the application was submitted at least five years before the current license expires. Indian Point Unit 2, located on the Hudson River north of New York City, currently continues to operate according to this process, known as timely renewal. To date, Indian Point Unit 2 is the only reactor that has entered the process of timely renewal.

NRC also expects to receive license renewal applications from seven more reactors between 2015 and 2018. Plans for only one plant have not yet been announced; however, license expiration for this plant is not a near-term issue.

Scientists of the USGS Hawaiian Volcano Observatory conducted ground observations of the June 27th lava flow on Tuesday, October 28, 2014. The flow continued to move through private property today. The advance rate of the narrow leading edge has been variable over the past day, and as high as 16 meters (17 yards) per hour. The flow width was less than about 50 meters (55 yards) at the leading edge and as wide as 150 meters (165 yards) immediately upslope as breakouts have occurred along margins of the flow. Portions of the flow continued to inflate by as much as 2 meters as new fresh new lava was delivered to the advancing flow front.

As of 5:30 PM, the flow was 310 meters (340 yards) in a straight line distance from Pāhoa Village Road and about 900 meters (985 yards) in a straight-line distance from Highway 130.

The lava lobe upslope of Apa`a Street advanced about 30 meters (82 yards) since yesterday.

Daily updates about Kīlauea’s ongoing eruptions, recent images and videos of summit and East Rift Zone volcanic activity, and data about recent earthquakes are posted on the HVO Web site at http://hvo.wr.usgs.gov.

Dennis Gartman has a new forecast for oil: a lot lower.

In an appearance on CNBC’s Fast Money on Monday, Gartman, publisher of the Gartman Newsletter, said that crude oil prices will fall demonstrably from current levels.

Earlier on Monday, it had been reported that Gartman saw crude oil going to $10 a barrel, but he backed a bit off that claim in his appearance on Monday, saying that maybe next time he ought to be a bit more circumspect when he talks to CNBC’s producers.

Dennis Gartman We're Witnessing The End Of The Oil EraBut the central spirit of Gartman’s not quite $10 call was still intact, with Gartman saying simply that the era of oil is over. At one point, Gartman went so far as to compare crude oil to whale oil, which became obsolete following the advent of crude in the early 20th century.

In discussing the “end of oil,” Gartman referenced news from Lockheed Martin earlier this month that the aerospace giant has made a technological breakthrough in developing a power source based on nuclear fusion. And while Business Insider’s Jessica Orwig reported that some in the scientific community are skeptical of this breakthrough, Gartman sees the potential in this breakthrough as being something of a death knell for oil.

Gartman also referenced other factors weighing on oil prices, namely a supply glut and a market that is contango.

A market is said to be in contango when the futures contract for a commodity is more than what the expected price will be in the future.

So basically, if I pay $80 for a futures contract for a barrel of oil I want to get next year, but if expectations are that the spot price of a barrel of oil will be $60 in a year, the futures contract — again, assuming the spot price doesn’t move — will have to fall.

Feldheim (Germany) (AFP) – If Germany has taken a pioneering though risky role in shifting to renewable energy, then the tiny village of Feldheim — population 150 — is at its vanguard.

The hamlet near Berlin is Germany’s first to have left the national grid and switched to 100 percent local, alternative energy, swearing off fossil fuels and nuclear power decades before the rest of the country plans to near the same goal.

Electricity now comes from a wind park towering over its gently rolling fields and reaches homes through Feldheim’s own mini smart grid.

More than 99 percent of the wind power is sold into the national system, along with electricity from a solar park on a former Soviet military base.

As winter nears, people here will heat their homes from a biogas plant powered by local pig and cattle manure and shredded corn, while on the coldest days a woodchip plant will also burn forestry waste.

The villagers took bank loans and state subsidies to build the system, in partnership with green power company Energiequelle, but say it is paying off as electricity and heating bills have been slashed.

Feldheim no longer pays for 160,000 litres (40,000 gallons) of heating oil a year, said Werner Frohwitter of the local energy cooperative.

“This money is no longer going to Arab sheiks or (Russian President) Vladimir Putin,” he said at the village 80 kilometres (50 miles) southwest of Berlin. “This money is now staying right here.”

– Green vision, risky gamble –

Depending on who you listen to, Germany’s “Energiewende” or energy shift is a bright green vision for a zero-carbon future or a reckless gamble that will drive Europe’s biggest economy against the wall.

It is certainly Germany’s biggest infrastructure project since World War II and its greatest national challenge since reunification 25 years ago.

North Dakota: $200M, 20,000-barrel-a-day Oil Refinery Could get Green Light

DEVILS LAKE, N.D. – A $200 million, 20,000-barrel-a-day clean fuels oil refinery could be operating near Devils Lake within three years.

The refinery, similar to one being built in Dickinson, would employ about 100 people and could create as many as 400 spin-off jobs in the area, according to Rachel Lindstrom, executive director of Forward Devils Lake, the region’s economic development agency.

“It’s very exciting for Devils Lake,” she said, “a great opportunity.”

Devils Lake City Commission approved a letter of support for the project this week.

The refinery is being proposed by Eagles Ledge Energy Ltd., based in Vancouver, B.C., which is working with Triad Engineering Ltd, of Calgary, Alberta.

If approved, the refinery would be built just northwest of Devils Lake, adjacent to the Devils Lake Industrial Park. Developers have an offer pending to purchase 300 acres of land, according to Lindstrom. The company would also build its own railroad spur from nearby tracks.

If approved, the refinery could be operating as early as 2017.

It would produce off-road diesel fuel, which is used in farm and construction equipment, as well as a variety of other products.

“Ideally, they’d like to keep the product close. We’d like to see the diesel kept here, to keep costs down,” Lindstrom said.

The refinery, which would operate on natural gas, would be located near an existing MDU Resources natural gas line.

The refinery would bring in crude oil from the Bakken Formation by rail or truck, with the finished products being trucked to their destinations.
